Privacy and Anonymity

We will not share any private information or even your de-identified responses with others without your having consented. 

Some of our tools can be used without ever revealing your name or email address or any contact info. We are fine with visitors and people who want to maintain full anonymity. We exist for you and wish you well in getting out from under oppressors and victimizers and personal shortcomings.

Incidentally, as we grow we will not likely have time or availability to read or even see your responses beyond your privacy elections. 

We are not a crisis or response service.

Near the end of our tools you can opt to add an email address to receive an email copy of your answers upon submission, or for announcements. Providing your email is not required. You can sign up for announcements independently on the contact page at incapaz.org.

De-Escalator and Trauma CPR are tools to educate people and let them express their feelings in productive and organized ways. Any user can submit responses, which now or in the future may be able to include other content like photos, videos, and links to other websites. What a user submits can only be seen by Incapaz staff, and responses are automatically sent to any email addresses users choose to enter as part of their responses (optional).

iNCAPAZ! Servicetries (we, us, our), is the owner and operator of the website www.De-Escalator.org, Incapables.org, and incapaz.org and associated applications for use on mobile and nonmobile devices (together referred to as Site). By using the Site you agree to use the Site subject to the Terms and Conditions and this Privacy Policy.

Personal Information

This Privacy Policy describes how and when we collect and use personally identifiable information provided by users of the Site (you), which may include, but is not limited to, your username, email address, avatar and other like information (Personal Information). It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information.

This policy covers any Personal Information collected or received by us as a result of your use of the Site, in relation to any posts you make and your use of any of our services or products.

Although we will not make your Personal Information publicly available except in accordance with this policy, you can limit the amount of Personal Information you provide by not registering an account, or  registering an account on the Site using an email address which is not linked to your social media accounts. You may wish to create an email account with an email provider that does not require Personal Information in order to register, such as Hotmail or Gmail.

Our Policy Towards Children

Our services and use of the Site are forbidden to persons under 16 without the prior consent of their legal guardian.

If you are a legal guardian and you become aware that your child has provided us with Personal Information without your consent, please contact us via our contact form. We do not knowingly collect Personal Information from children under 16. If we become aware that a child under 16 has provided us with Personal Information, we will take steps to remove that Personal Information and to delete the child’s responses.

you register as a user of the Site or any of our services; and

Incapaz recognizes the trust you place in us when you give us your Personal Information. To the extent that these organizations and service providers gain access to your Personal Information, they are covered by strict privacy rules that prevent them from keeping this information or using this information for any purpose. We will not share your personal information with any third party organizations for marketing purposes without your consent.

Cross Border Transfers

Information that Incapaz collects may be stored and processed in and transferred between any of the countries in which the Company operates to enable the use of the information in accordance with this policy. In addition, Public Information that you submit for publication on the Site will be published on the internet and may be available around the world. By using the Site and Incapaz’s services you agree to such cross-border transfers of your Personal Information.

Security

The security of your personal information is important to us. We endeavor to take all reasonable steps to keep your Personal Information secure. We store this information on secure cloud-based servers based in the USA and the EU in protected access-controlled facilities. Once it is stored on those servers, only authorized users can access your Personal Information, and access is only for approved purposes.

Incapaz is not responsible for any third-party access to your Personal Information as a result of:

interception while it is in transit over the internet;

spyware or viruses on the device (such as a computer or phone) from which you access the Site or submission to De-Escalator;

your failure to adequately protect your email, username, unique identifier, or password;

or any losses, expenses, damages, including legal fees, resulting from such access.

We enable you to submit responses. We cannot control the actions of others with whom you may choose to share your information.

Providing information on other sites

The Site provides links to some other sites outside of the Site. Sometimes other sites – such as other social networking sites – link back to the Site. These linked Sites are not under our control, so we are not responsible for the conduct of companies linked to our Site. Before you enter information on those sites, you should look at their privacy policy and terms and conditions of use.

Accessing information we keep about you

You can access your Personal Information we hold about you at any time. Simply contact us to make your request. We will always endeavor to meet your request for access. However, in some circumstances we may decline a request for access. This includes the following circumstances:

we no longer hold or use the information;

providing access would have an unreasonable impact on the privacy of other persons;

the request is frivolous or vexatious;

this information relates to existing or anticipated legal proceedings and would not normally be disclosed as part of those proceedings;

For example, document retrieval, photocopying, labor and delivery to you. We will not charge you to make a request to access your information.

Despite anything contained in this Policy to the contrary, the Freedom of Information Act 1982 continues to apply to any Personal Information held by us. The access and correction requirements in the Privacy Act 1988 operate alongside and do not replace other informal or legal procedures by which an individual can be provided access to, or correction of, their Personal Information.
